Prosecutors signal defeat in Broadcom case - OCRegister
SANTA ANA – Federal prosecutors on Friday said they will not appeal a
judge's decision to toss their prosecution of Broadcom
Corp. executives, including co-founders Henry Nicholas
III and Henry T. Samueli.
The government filed motions asking the 9th U.S. Circuit Court of
Appeals to dismiss notices of appeal filed in the cases of Nicholas,
Samueli and former Broadcom vice president of human resources Nancy
Tullos, according to U.S. Attorney spokesman Thom Mrozek.
"After a thorough evaluation of the issues associated with the cases,
the government decided to not pursue the appeals,'' he said in a
statement. Mrozek declined to further comment.
Nicholas, in a statement, said: "The decision by the Department of
Justice reconfirms my faith in our criminal justice system."
Samueli's attorney, Gordon Greenberg said that he was "simply
delighted that the Department of Justice has done the right thing."
The decision is an acknowledgement of defeat for the government.
Prosecutors initially reserved their right to appeal a January decision
by U.S. District Judge Cormac J. Carney. Citing government misconduct,
Carney dismissed securities
fraud charges against Nicholas. In an earlier ruling,
Carney threw out a criminal charge and a guilty plea by Samueli.
The government's battle against Broadcom executives began in June
