Hmm, is right. They're a little fast and loose with when ERISA applies as opposed to contract principles or labor laws in the examples they provide. If they are actually pursuing some of these examples, a victory is likely to have little effect on others as the circumstances are unusual and egregious or the claims will likely be summarily dismissed.
